DC Circuit Gitmo Case

A Chinese Muslim named Huzaifa Parhat has been in American custody for more than six years. He has never been charged with a crime. The DC Court invalidated a finding that Mr. Parhat was an “Enemy Combatant.” This man has been in solitary confinement for years, and now it turns out that there is no evidence he ever did anything to America or Americans.

The government’s rationalization for putting this guy in a prison camp without authority was based on un-sourced allegations, and the government basically argued that the truth of their allegations was assured because the government said so. A judge quoted from Lewis Carroll’s “Jabberwocky” from the bench during argument.
